Legal Reminder: The Electronic Payslip

The decree n°2016-1762, which came into effect on January 1, 2017, governs the dematerialization of payslips and their accessibility.

The employer must respect the following conditions:

  • Duty to inform – The employer must inform its employees of the upcoming changes at least 1 month before the effective implementation. The latter are free to express their right of opposition if they wish to keep a paper payslip.
  • Right of opposition – Employees have the right to refuse an electronic payslip, before or after its implementation. The change must be taken into account by Human Resources within a maximum of 3 months.
  • Readable format and long-term archiving – The payslips are issued in a readable and durable format (PDF), electronically signed to guarantee their integrity and kept for 50 years or until the employee is 75 years old. »
